All the Member States of the European Union, the Swiss Confederation and the Member States of the European Free Trade Association are bound by Directive 2005/36/EC of 7 September 2005 on the recognition of professional qualifications. This Directive was implemented into the Polish legal system by the Act of 22 December 2015 on the rules for recognising professional qualifications acquired in the Member States of the European Union.
The Office of Technical Inspection is authorised to recognise qualifications upon which the pursuit of regulated professions, or the access to or pursuit of certain activities is contingent to the extent specified in this Regulation.
The Office of Technical Inspection is authorised to recognise qualifications upon which the pursuit of the following regulated professions is contingent:
- operator of lifts,
- operator of cranes,
- maintenance worker for lifts,
- maintenance worker for cranes,
- operator of lift trucks with mechanical lifting drive,
- maintenance worker for lift trucks with mechanical lifting drive,
- filler of mobile tanks.
The UDT recognises qualifications for the following activities:
The Office of Technical Inspection is authorised to recognise qualifications upon which the access to or pursuit of certain activities specified in the Prime Ministerial Regulation of 9 December 2008 on the assignment of activities falling under ISIC or NICE codes to the Polish Classification of Professional Activities, resulting from Annex IV to Directive 2005/36/EC of the European Parliament and of the Council of 7 September 2005 on the recognition of professional qualifications, is contingent:
- manufacture of tubes, pipes, hollow profiles and related fittings, of steel,
- forging, pressing, stamping and roll-forming of metal,
- manufacture of metal structures and parts of structures,
- manufacture of central heating radiators and boilers,
- manufacture of lifting and handling equipment,
which correspond to activities in the area of manufacture and repair of technical equipment and materials and components used to manufacture, repair or upgrade this equipment, specified in the technical inspection rules.
Proceedings for the recognition of qualifications begin when an application for initiation of proceedings for the recognition of qualifications is submitted. Applications for the recognition of qualifications are submitted in Polish. Documents enclosed with applications are submitted in Polish or together with a translation into Polish by a sworn translator.
Fees
In accordance with Article 14 of the above Act of 22 December 2015, a fee equal to 35 % of the minimum remuneration determined pursuant to the Minimum Remuneration Act of 10 October 2002, applicable in the year in which proceedings are initiated, is charged for conducting proceedings and issuing a decision on the recognition of professional qualifications.
Accordingly:
- the fee for conducting proceedings and issuing a decision on the recognition of qualifications in 2021 amounts to PLN 980.00
- the fee is paid to the bank account of the Office of Technical Inspection, account number: 05 1130 1017 0020 1214 7720 0001
In the transfer title, it should be indicated that the fee concerns the recognition of qualifications, and the full name of the person whose qualifications are to be recognised should be included.
Information for persons leaving Poland
Qualification certificates issued by the Office of Technical Inspection are valid in Poland. The national legislation of the country concerned applies outside Poland.
The Member States of the European Union, the Swiss Confederation and the Member States of the European Free Trade Association are bound by Directive 2005/36/EC of 7 September 2005 on the recognition of professional qualifications.
This Directive requires that the above countries introduce provisions for the recognition of professional qualifications acquired in other countries from this group. Proceedings for the recognition of qualifications may be conducted in different ways in different countries. Detailed information on the provisions on the recognition of qualifications in force in individual countries may be obtained in Contact Points that have been set up in all the countries required to mutually recognise qualifications.
